Terms of Use

These terms are the agreement between you and Create Space. Please read them — by using our website or joining early access, you accept them. They cover what the service is, how you may use it, and — importantly for a meeting tool — your responsibility to record lawfully.

1. Acceptance of these terms

By accessing createspace.in, requesting early access, or using Create Space (the "Service"), you agree to these Terms of Use. If you are using the Service on behalf of an organisation, you confirm you have authority to bind that organisation, and "you" includes it. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 18 years old and legally able to enter into a contract under the Indian Contract Act, 1872 (or the equivalent law that applies to you). The Service is not available to anyone barred from using it under applicable law.

3. The service & early access

Create Space is a private, data-driven leadership-coaching tool that analyses the dynamics of your meetings and gives you feedback and guidance. The Service is currently in early access (beta). That means:

  • features may change, be added, be removed, or occasionally break;
  • it is provided on an "as is" and "as available" basis, without guarantees of uptime or accuracy; and
  • its coaching insights are for your development only — they are not professional, legal, medical, HR, or psychological advice, and are not a substitute for your own judgement.

4. Your account

If you create an account, you agree to give accurate information, keep your login credentials secure, and take responsibility for activity that happens under your account. Tell us promptly at hello@createspace.in if you suspect unauthorised use.

5. Acceptable use

You agree not to:

  • use the Service for anything unlawful, or in breach of anyone's rights;
  • upload content you do not have the right to upload;
  • use the Service to surveil, profile, or harm other people;
  • attempt to reverse-engineer, scrape, overload, disrupt, or gain unauthorised access to the Service; or
  • misrepresent your identity or your authority to act for an organisation.

6. Recording meetings & consent

This clause matters. Please read it. Create Space works with recordings of your real meetings, which may include other people. You are responsible for recording them lawfully.

For every meeting you record or upload, you represent and warrant that you have the legal right and all necessary consents to do so, and that you have given every participant any notice the law requires. Recording laws differ by place — some require the consent of all participants — and separate rules can apply to voice and biometric data. It is your responsibility to comply with the recording, privacy, wiretap, and data-protection laws that apply to you and your meetings. If a claim arises because you recorded or submitted a meeting without the proper right or consent, you agree to indemnify Create Space as set out below.

7. Privacy

Our Privacy Policy explains how we handle your personal data. In short: coach, not spy — your analysis is private to you, and we store the lesson, not the tape. By using the Service you also agree to the Privacy Policy.

8. Intellectual property & your content

Create Space, including its software, design, and brand, belongs to us and our licensors. You keep ownership of the content you upload (such as your meeting audio). You grant us a limited, revocable licence to process that content solely to provide the Service to you — for example, to generate your insights — after which we delete the raw audio as described in the Privacy Policy. We will not use your audio to train third-party models or for any purpose beyond delivering the Service, unless you separately and expressly agree.

9. Feedback

If you send us ideas or suggestions about the Service, we may use them freely, without any obligation to you.

10. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available", and we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that its insights are accurate or complete.

11. Limitation of liability

To the fullest extent permitted by law, Create Space and its founder will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits, lost data, or loss of goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim, or [INR 5,000] [before publish: confirm the cap with counsel; the Service is currently free]. Nothing in these terms excludes liability that cannot be excluded under applicable law.

12. Indemnification

You agree to indemnify and hold harmless Create Space and its founder from any claims, losses, and reasonable costs arising from your breach of these terms, your misuse of the Service, or — in particular — any meeting you recorded or submitted without the right or consent required by Section 6.

13. Termination

You may stop using the Service at any time. We may suspend or end your access — especially for a breach of these terms — at any time during early access, with or without notice. When your access ends, we will handle your data as described in the Privacy Policy, including deleting it where appropriate.

14. Governing law & disputes

These terms are governed by the laws of India. You agree that the courts at [city], India, will have jurisdiction over any dispute, unless the law that applies to you requires otherwise. [before publish: set your city/venue, and decide with counsel whether to add arbitration.]

15. Changes to these terms

We may update these terms as the Service grows or the law changes. When we make a material change, we'll update the "Last updated" date above. If you keep using the Service after a change takes effect, you accept the updated terms.
